1. Acceptance of Terms

By accessing and using Smart Match ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Service Description

Smart Match provides AI-powered resume analysis services that compare your resume against job descriptions to provide match scores, identify gaps, and generate personalized recommendations and cover letters.

The Service includes the Smart Match web app, Chrome extension, Firefox add-on, and iOS app. Features and limits may vary by platform and are described within each product.

For authenticated web app users, the Service also stores your job analysis history (including results, notes, and application tracking) on our servers and sends email notifications to your registered address when an analysis is complete. See our Privacy Policy for details on what is stored and how long it is kept.

To keep the Service stable and secure, we use application monitoring tools, including New Relic, to detect outages, measure performance, and investigate errors.

3. Account Registration

  • Accounts are required for the web app and browser extensions; the iOS app does not require an account
  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use this Service
  • One account per user; multiple accounts are prohibited
  • You are responsible for all activities under your account

4. Subscription Plans and Billing

4.1 Free Plan

  • Usage limits are shown in the product and may vary by platform
  • Usage resets daily
  • No credit card required to access the free tier

4.2 Premium Plan

  • Pricing and limits are shown in the product or App Store and may vary by platform
  • Provides higher daily limits and premium features
  • Billed on a recurring basis according to the plan you select
  • Can be cancelled at any time

4.3 Payment Terms

  • Web app and browser extensions: payments are processed securely through Stripe
  • iOS app: payments are processed by Apple In-App Purchases
  • Subscription fees are non-refundable except where required by law
  • You authorize recurring charges according to the plan you select
  • Prices may change with prior notice as required by law or platform policies
  • Failed payments may result in service suspension or loss of premium access

5. Cancellation and Refunds

  • You may cancel your Premium subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused analyses
  • Upon cancellation, your account reverts to the Free plan
  • Access to Premium features continues until the end of the paid period
  • For iOS subscriptions, cancellations and refunds are managed through your Apple ID settings

6. Acceptable Use

You agree NOT to:

  • Upload malicious files or content that violates laws
  • Attempt to bypass usage limits or security measures
  • Use automated tools to scrape or abuse the Service
  • Share your account credentials with others
  • Reverse engineer or copy our technology
  • Upload resumes or content belonging to others without permission
  • Use the browser extensions on pages you are not authorized to access or in violation of third-party site terms
  • Use the Service for any illegal or unauthorized purpose

7. Intellectual Property

  • You retain ownership of your resume content and uploaded files
  • Analysis results and recommendations are provided for your personal use
  • Our Service, technology, and brand are protected by intellectual property laws
  • You grant us a limited license to process your resume for analysis purposes, to store analysis results in your account history, and (when using the Resume Profiles feature) to extract and store structured resume data in your private account

8. Data Storage and Privacy

Your use of the Service is subject to our Privacy Policy. We process and store your personal data in accordance with GDPR and applicable data protection laws. By using the Service, you consent to such processing and storage.

Key points regarding data storage for authenticated web app users:

  • Job analysis results, metadata, notes, and usage events are stored on our servers linked to your account
  • Resume files uploaded for job/match analysis are never stored — they are transmitted for analysis and immediately discarded
  • Resume files uploaded via the Resume Profiles feature are stored in your private, encrypted AWS S3 storage. You can delete them at any time.
  • Structured resume data extracted from your PDF (name, work experience, education, skills, contact details) is stored privately in your account. It is never shared publicly unless you explicitly enable sharing. Even when shared, your email address and phone number are always hidden.
  • Job completion summaries are sent to your registered email address via AWS SES
  • Limited technical telemetry (for example, performance metrics and error logs) is processed via New Relic for service monitoring
  • Your data is retained for the period configured in your account settings (default: 365 days; range: 30–3,650 days)
  • You can export or permanently delete your stored data at any time from your account settings

If you use the iOS app, Apple's standard End User License Agreement (EULA) also applies. In case of conflict, the Apple EULA governs.

9. Disclaimers and Limitations

  • The Service is provided "AS IS" without warranties of any kind
  • We do not guarantee job placement or interview success
  • Analysis results are AI-generated and may contain errors
  • We are not liable for decisions made based on our recommendations
  • Service availability is not guaranteed; maintenance may cause downtime
  • We reserve the right to modify or discontinue features at any time

10. Limitation of Liability

To the maximum extent permitted by law, Smart Match and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Smart Match from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

12. Termination

  • We may suspend or terminate your account for violations of these Terms
  • You may delete your account at any time
  • Upon termination, your right to use the Service ceases immediately
  • We will delete your stored job data within a reasonable period following account deletion, except where retention is required by law

13. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the European Union and Germany. Any disputes shall be resolved in the courts of Germany.

15. Dispute Resolution

For EU users: In accordance with EU regulations, you have the right to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/
